BOARD OF DIRECTORS MEETING

CALL TO ORDER, STATEMENT OF ADVERTISEMENT AND OPEN MEETING LAW NOTIFICATION:

The special meeting of the Board of Directors was called to order at 7:05 P.M. by Vice-Chairman Gregg Felker.

ADOPTION OF AGENDA: (Dale Wiles arrived 7:10 P.M.)

]It was moved by Jeff Krebs and seconded by Janet Koinzan to adopt the agenda.  AYE:   Childers, Dvorak, Felker, Gotschall, Green, Heithoff, Hughes, Knuth, Koinzan, Krebs, Russman, & Wiles.  NAY:  None.  ABSTAIN:.  ABSENT:  Dierks, Keller, Stewart.  MOTION CARRIED. 

REVIEW OF LB 483 JANUARY 2010 APPLICATIONS:

The Upper Elkhorn NRD Directors and staff reviewed the LB 483 January 2010 applications for the expansion of acres.     ]It was moved by Janet Koinzan and seconded by Gregg Felker to approve the expansion of 1671 acres and notify the January 2010 applicants by Certified Mail with a return receipt.  AYE:  Childers, Dvorak, Felker, Gotschall, Green, Heithoff, Hughes, Knuth Koinzan, Krebs, Russman & Wiles.  NAY:  None.  ABSTAIN:  None.  ABSENT: Dierks, Keller, Stewart.  MOTION CARRIED. 

ELM MODEL-USGS & DNR:

Dennis updated on the status of the Elm Model in relations to LLNRD, ULNRD, LENRD, USGS & DNR.  The Elm group is looking at a meeting at the LENRD in the next couple of weeks to take a look at where the Elm project is heading.  The board stressed they would be interested in setting in on the meeting.  Will update board with date and time.

NIOBRARA ACRE CERTIFICATION FORM:

The board reviewed the Irrigated Acre Certification (Niobrara River Designation) form.  Request to add to letter “H”, to read as “Maximum acres that have been Ground Water Irrigated at least one (1) time during the calendar year 2002-2007.

]It was moved by Gregg Felker and seconded by Dale Wiles to approve the Irrigated Acre Certification form. AYE:  Childers, Dvorak, Felker, Gotschall, Heithoff, Hughes, Knuth Koinzan, Krebs, Russman & Wiles.  NAY:  Green None.  ABSTAIN:  None.  ABSENT:  Dierks, Keller, Stewart .  MOTION CARRIED.   

UENRD-GWMP LB483 Rules & Regulations:

The GWP LB483 Rules & Regulations were reviewed by the board.  Modifications will be made by Dennis and reviewed at the next board meeting.

EXCUSED ABSENCES:

]It was moved by Curtis Gotschall and seconded by Ted Hughes to excuse the absence of Chris Dierks, Jim Keller and Roy Stewart.  AYE:  Childers, Dvorak, Felker, Gotschall, Green, Heithoff, Hughes, Knuth, Koinzan, Krebs, Russman &Wiles.  NAY:  None.  ABSTAIN:  None.  ABSENT:  Dierks, Keller & Stewart.  MOTION CARRIED. 

There being no further business the meeting was adjourned at 9:10 P.M.
